Steve Jones: OUT of The X Factor


After a month of speculation that Steve Jones is leaving The X Factor, the host confirmed Monday that he's indeed packing it in after the inaugural US season.

On his Twitter page, Jones calls his departure "a shame," but adds, "I can't complain as I've had a great time. Good luck to everyone on the show."

He gave no reason why he wasn't returning for a second season.

Last month, a rep for the Welsh TV star called reports of his firing "a fabrication," though the show's producer and judge, Simon Cowell, promised changes.

Cowell recently refused to deny reports that Jones was getting axed. Nicole Scherzinger is also rumored to be exiting, though that hasn't been confirmed.

"I don’t think he did a bad job but ... there is a Brit limit on the show," he told the U.K.'s Mirror, implying that a shake-up was in the works ... which it was.

(AP) ? Nestled among the few remaining businesses that dot a rundown highway in this dusty West Texas town stands what's become a surprise destination for marijuana-toting celebrities: the Hudspeth County Jail.

Willie Nelson, Snoop Dogg and actor Armie Hammer have been among the thousands of people busted for possession at a Border Patrol checkpoint outside town in recent years, bringing a bit of notoriety to one of Texas' most sparsely populated counties.

"Once I was in Arizona, and when I said where I was from, they said, 'That's where Willie Nelson was busted,'" said Louise Barantley, manager at the Coyote Sunset souvenir shop in Sierra Blanca.

Hudspeth County cameos aren't only for outlaws: Action movie star Steven Seagal, who's already deputized in Louisiana and Arizona for his reality show "Steven Seagal Lawman" on A&E, has signed on to become a county officer.

Locals already have found ways to rub shoulders with their celebrity guests.

Deputies posed for pictures with Snoop Dogg after authorities said they found several joints on his bus earlier this month. When Nelson was busted here in 2010, the county's lead prosecutor suggested the singer settle his marijuana charges by performing "Blue Eyes Crying in the Rain" for the court. Nelson paid a fine instead, but not before county commissioner Wayne West played one of his own songs for the country music legend.

West acknowledged he's a big fan of Nelson and wanted to capitalize on a golden chance to perform for such a noted "captive audience."

"Willie loved the song, he is a real outgoing individual" he added.

The once-thriving town of Sierra Blanca began to shrink to its current 1,000-person population after the construction of nearby Interstate 10 ? a main artery linking cities from California to Florida ? offered an easy way to bypass the community.

Now the highway is sending thousands of drug bust cases Sierra Blanca's way, courtesy of a Border Patrol checkpoint just outside of town where drug-sniffing dogs inspect more than 17,000 trucks, travelers ? and tour buses ? daily for whiffs of contraband that may have made its way inland from the border.

Hudspeth County Sheriff Arvin West, younger brother of the musically inclined commissioner, said his office handled about 2,000 cases last year, most of them having to do with drugs seized at the checkpoint.

Border Patrol agents say people busted with small amounts of pot often say they have medical marijuana licenses from California, Arizona or New Mexico ? three states along I-10 that, unlike Texas, allow for medicinal pot prescriptions ? and claim to believe the licenses were valid nationwide.

Nelson's publicists declined to comment about the specifics of the singer's case. Representatives for Snoop Dogg, who will pay a fine and court costs after being cited for possession of marijuana paraphernalia, did not return several messages seeking comment.

County authorities have not yet decided whether to prosecute or issue a citation for Hammer, who starred in the 2010 film "The Social Network" and more recently played the FBI's number two man in "J. Edgar" He was arrested in November on his way to his wife's bakery in San Antonio after authorities said they found marijuana-laced brownies and cookies. His attorney Kent Schaffer has called the case a "total non-issue."

Local officials say they're not on a celebrity witch hunt, but some residents are enjoying the publicity from the high-profile arrests. They say the once forgotten town of Sierra Blanca should take pride in not pandering to famous people caught breaking the law.

"We get attention because something is being done right," resident Adolfo Gonzalez said while shopping at a local convenience store. "It'd be worse if we'd let them go because they are celebrities."

That's not expected to change when Seagal comes to town. Sheriff West insists the "Under Siege" star hasn't indicated any plans to film his show here ? but the sheriff isn't ruling it out.

"If he wants to, we can do it but that's not what he said this was about," West said.

West's spokesman, Rusty Flemming, said Seagal will patrol the area and train colleagues in martial arts and weapons techniques. The actor is expected to arrive in Hudspeth County within months, once he's done filming a new movie in Canada.

Seagal's management agency did not return calls and emails seeking comment about his plans in Texas.

Commissioner West, meanwhile, is keeping his musical skills sharp ? just in case another performer pays a surprise visit to the county jail. The lead guitarist and vocalist of a local band, West said he regrets not having a chance to sing for Snoop Dogg, but wasn't sure if the rapper would have enjoyed the performance anyway.

"Our stuff is laid back," he said. "Mas o menos (more or less) country."

Outrage as bodies pile up at Cook County morgue

Cook County officials say they are being forced to change morgue procedures due to an overflow of unclaimed bodies. Charlie Wojciechowski reports.

CHICAGO ? Outraged pastors and community activists on Friday descended upon the Cook County Medical Examiner's Office and called for an independent investigation after reports that bodies have been piling up for weeks.

At least one activist openly called for the facility's director, Dr. Nancy L. Jones to step down.

"Somebody needs to be held accountable for what happened," said Dawn Valenti, who works to help families find missing loved ones.

Cook County Board President Toni Preckwinkle a day earlier said Jones will remain -- for now -- but called for a top-to-bottom review of the facility.


"This is a reminder of how my ancestors -- how the remains of our ancestors were treated like garbage," Peggy Hudgens said through tears at the building at 2121 W. Harrison St.

Hudgens claimed to have been trying to resolve her brothers death and burial since October.

The issue has been simmering for months, if not years. As many as 363 bodies were reportedly once collected in a cooler designed to hold just 300. Ministers gathered Friday to pray for the deceased and to call for justice.

Anti-violence community activist Andrew Holmes was among the protesters and wondered aloud about the accountability of missing persons at the morgue.

"We want those deceased finger-printed and identified. We still have a lot of missing, unclaimed and missing people that have not been found," he said.

Holmes focused specifically on Carmelita Johnson, a woman who'd gone missing and was ultimately found in the facility. Her family said they tried to find her for more than a year. Johnson has since been buried.

The Illinois Department of Labor said it's also opened an investigation into "worker safety issues."

Pentagon cuts reshape military, trim costs (Reuters)

WASHINGTON (Reuters) ? The Pentagon unveiled a 2013 budget plan that would cut $487 billion in spending over the next decade by eliminating nearly 100,000 ground troops, mothballing ships and trimming air squadrons in a bid to create a smaller, agile force with a new strategic focus.

The funding request, which includes painful cuts that will be felt across the country, comes at a historic turning point for the military as it winds down 10 years of war in Afghanistan and Iraq and shifts its strategic focus to the Asia-Pacific region and the Middle East.

The budget plan, sharply criticized by some lawmakers, sets the stage for a new struggle between President Barack Obama's administration and Congress over how much the Pentagon should spend on national security as the country tries to curb its trillion-dollar budget deficits.

"Make no mistake, the savings that we are proposing will impact all 50 states and many districts, congressional districts across America," Defense Secretary Leon Panetta told a news conference at the Pentagon on Thursday.

"This will be a test of whether reducing the deficit is about talk or action."

Panetta, previewing a budget to be made public February 13, said he would ask for a $525 billion base budget for the 2013 fiscal year, the first time since before the September 11, 2001, attacks that the Pentagon has asked for less than the previous year. That compares with $531 billion approved this year.

Panetta said he would seek $88.4 billion to support overseas combat operations, primarily in Afghanistan, down from $115 billion in 2012 largely due to the end of the war in Iraq and the withdrawal of U.S. forces there at the end of last year.

Congress ultimately controls the Pentagon's purse strings and regularly intervenes to change the size and detail of military spending as it sees fit. The Defense Department's budget accounts for about 20 percent of total federal spending.

Republican lawmakers who oversee military affairs on Capitol Hill sharply criticized the plan.

Senator John McCain said it "ignored the lessons of history" by imposing massive cuts on the military, and Representative Buck McKeon said it reflected "Obama's vision of an America that is weakened, not strengthened, by our men and women in uniform."

MORE CUTS TO COME?

The 2013 budget is Panetta's first as defense secretary and is the first to take into account the Budget Control Act passed by Congress in August that requires the Pentagon to cut $487 billion in projected spending over the next decade.

The budget plan does not take into account an additional $600 billion in defense cuts that could be required after Congress failed to pass a compromise agreement to cut government spending by $1.2 trillion. The Pentagon could face cuts of another $50 billion a year, starting in 2013, unless Congress changes the law.

Panetta said he hoped once lawmakers understood the sacrifice involved in reducing the defense budget by almost a half a trillion dollars, they would make sure to avoid another $500 billion in additional cuts that would "inflict severe damage to our national defense for generations."

The budget begins to flesh out a new military strategy announced by the Pentagon earlier this month that calls for a shift in focus from the ground wars of the past decade towards efforts to preserve stability in the Asia-Pacific region and the Middle East.

"To ensure an agile and ready force, we made a conscious choice not to maintain more force structure than we could afford to properly train and equip," Panetta said.

The budget plan would provide new challenges for the Pentagon's top suppliers, such as Lockheed Martin, Boeing, General Dynamics, Northrop Grumman and Raytheon. The Arca index of defense stocks closed Thursday down 0.7 percent.

The plan retains but slows the purchase of weapons like Lockheed's F-35 Joint Strike Fighter, the Pentagon's largest procurement program, as well as submarines, amphibious assault ships and other vessels. It would retain a fleet of 11 aircraft carriers.

The Pentagon would boost its emphasis on special operations forces like those who carried out the raid in Pakistan that killed al Qaeda leader Osama bin Laden last year and rescued two aid workers this week from kidnappers in Somalia.

It would also increase its emphasis on cyber operations, expand its work on drone aircraft, go ahead with a long-range bomber and proceed with other weapons that would allow it to project power from a greater distance.

Those capabilities are needed as countries like Iran and China develop arms that could threaten U.S. aircraft carriers in international waters near their shores.

General Martin Dempsey, the top U.S. military officer as chairman of the Joint Chiefs of Staff, warned against "parsing through each cut, each change, to look for a winner or loser," saying the plan should be judged for how it adapts the military to a changing security environment.

While the cuts announced on Thursday would affect all major defense contractors, consultant Loren Thompson said shipbuilders would be hit particularly hard because of the plan to cut 16 vessels from the total planned for the next five years.

The plans could affect work flow at Huntington Ingalls' shipyards in Pascagoula, Mississippi, and Newport News, Virginia.

The size of the active-duty Army would be trimmed to 490,000 over five years from its wartime peak of 570,000 in 2010 and the size of the Marine Corps would fall to 182,000 from its high of about 202,000.

Military pay increases would begin to slow after two more years of growth, and fees would be increased on healthcare benefits for military retirees, those who served more than 20 years, both above and below the age of 65.

In addition, the Pentagon would:

- Delay development of a new ballistic missile submarine by two years.

- Eliminate six of the Air Force's tactical-air fighter squadrons and retire or divest 130 aircraft used for moving troops and equipment.

(AP) ? Rihanna has found a unique way of getting some new stage outfits.

The musical superstar from Barbados will be hunting for undiscovered design talent in Britain on a new TV show ? as yet unnamed ? in which she will be the executive producer and the star.

Sky Living HD announced Thursday it has commissioned media company Twenty Twenty to make the series and say Rihanna will be working mainly behind the scenes.

Hosting duties will go to another pop name, Nicola Roberts from the U.K. group Girls Aloud.

Together they will challenge fashion newcomers to create stage gear for musicians and celebrities ? with the final task to dress Rihanna for her July 8 performance at the Wireless music festival in London's Hyde Park.

Starbucks posts profit beat, sales jump (Reuters)

(Reuters) ? Starbucks Corp's reported a quarterly profit that topped Wall Street's view after global economic worries failed to weaken demand for drinks and other products from the world's biggest coffee chain.

Based on its better-than-expected fiscal first-quarter results, the company raised the low end of its full-year profit forecast to a range of $1.78 to $1.82 per share from $1.75 to $1.82.

Starbucks shares, up roughly 45 percent from a year ago and hovering near all-time highs, were off 1.1 percent at $47.79 in extended trading.

Global sales at cafes open at least 13 months jumped 9 percent, helped by an increase in customer visits and spending per transaction. That beat the 7.7 percent gain analysts, on average, expected, according to Thomson Reuters data.

Net income was $382.1 million, or 50 cents per share, for the quarter ended January 1. That was up from $346.6 million, or 45 cents, in the year earlier period.

Analysts, on average, were looking for a profit of 49 cents per share in the latest quarter, according to Thomson Reuters I/B/E/S.

Total revenue rose 16 percent to $3.4 billion.

Rascal Flatts' Jay DeMarcus, wife expect 2nd child (AP)

NASHVILLE, Tenn. ? Rascal Flatts bassist Jay DeMarcus and his wife Allison are expecting their second child.

Jay DeMarcus calls the pregnancy "a huge surprise" in a Wednesday news release. The baby is due this summer and the couple is unsure whether daughter Madeline Leigh, born in December 2010, will have a little brother or sister.

Allison, a former Miss Tennessee who is an on-air personality at CMT, says they are preparing for "many sleepless nights ahead."

Rascal Flatts is currently on tour and recently announced the release of its next album, "Changed," on April 3.

Libyan defense minister in restive town for talks (Reuters)

TRIPOLI (Reuters) ? Libya's defense minister held talks on Wednesday with townsmen at Bani Walid, a former stronghold of Muammar Gaddafi where local fighters drove out a pro-government militia this week.

"The minister came here today and we are speaking to him to find a solution to this problem," said Abdul Azziz al-Jmaili, a member of a local council in Bani Walid, 150 km (90 miles) south of Tripoli, adding that government forces were around the town.

The minister, Osama al-Juwali, is part of the provisional government installed in November by the National Transitional Council (NTC), the self-appointed body which won Western backing in an uprising that ousted Gaddafi in August.

Jmaili, speaking to Reuters by telephone, said a "peacekeeping force" comprised of units of former rebel fighters loyal to the NTC and drawn from other towns in the region had set up checkpoints in the outskirts of Bani Walid.

On Monday, armed residents attacked the barracks of the NTC force in the town, killing four fighters by the account of the government militia, and forced the unit to retreat to beyond the desert city's limits.

Echoing complaints by residents that the pro-NTC fighters had been harassing people, making arrests and abusing prisoners, the town's elders said on Tuesday that they were appointing their own local government and did not want any interference from the authorities in Tripoli.

"NOT PRO-GADDAFI"

Bani Walid, stronghold of the Warfalla tribe which nominally counts about one Libyan in six among its members, was one of the last towns to surrender to the anti-Gaddafi rebellion last year.

This week's upheaval will heighten doubts about the NTC's ability to bring order and establish control over armed groups - goals crucial to rebuilding oil exports and securing Libya's vast desert borders in a region where al Qaeda is active.

People in Bani Walid reject accusations from NTC fighters that they remain loyal to Gaddafi, who was captured and killed in October after weeks on the run, or to his surviving sons, among them the now captive Saif al-Islam who staged his last stand in Bani Walid before fleeing into the Sahara in October.

Reuters reporters who toured Bani Walid on Tuesday saw no signs of the Gaddafi-era green flags which NTC supporters had earlier said had been hoisted over the town following the retreat of the pro-government militia.

Some pro-Gaddafi graffiti remains in the town, but the most common banners flying were the red, green and black tricolor of the NTC.

While Bani Walid was and remains a particular headache for the NTC, it is not alone. Towns and cities across the country are being run with little reference to central authority and in a number of areas old scores and local frictions are being fought over by groups which were nominally allies in the revolt.

Lessons in coral reef survival from deep time

ScienceDaily (Jan. 23, 2012) ? Lessons from tens of millions of years ago are pointing to new ways to save and protect today?s coral reefs and their myriad of beautiful and many-hued fishes at a time of huge change in the Earth?s systems.

The complex relationship we see today ?between fishes and corals developed relatively recently in geological terms ? and is a major factor in shielding reef species from extinction, says Professor David Bellwood of the ARC Centre of Excellence for Coral Reef Studies and James Cook University.

?Our latest research provides strong evidence for a view that today?s coral hotspots are both a refuge for old species and a cradle for new ones,? said Peter Cowman, lead author of a recent report. ??This is the first real inkling we?ve had that just protecting a large area of reef may not be enough ? you have to protect the right sorts of reef.?

Early coral reefs, 300-400 million years ago were much simpler affairs than today?s colourful and complex systems, Prof. Bellwood says. The fish were not specialised to live on or among corals ? either lacking jaws altogether, or else feeding on detritus on the seabed or preying on one another.

?By 200 million years ago we are starting to see fish with jaws capable of feeding on corals, but the real explosion in reef diversity doesn?t occur till about 50 million years ago when we see fishes very like today?s specialist coral feeders emerging.?

It is the ever-increasing complexity of this relationship between corals and fishes over the last 20 or 30 million years that produces the wondrous diversity of today?s reefs, he says. Each has become more critical to the survival of the other as their lives have become more interwoven.

?When people think of coral reefs, they usually think of the beautiful branching corals like staghorn (Acropora) ? well the evidence is now fairly clear that Acropora needs certain fish for it to flourish. But, it now appears that this may be a reciprocal relationship with Acropora being important for the evolution and survival of fishes on coral reefs. ?

Unfortunately Acropora corals are highly vulnerable to external impacts like Crown-of-Thorns starfish, coral bleaching, climate change and ocean acidification. Their demise will have far reaching effects on the fishes which interact with them, such as damsels, butterfly fish, cardinals and wrasses.

?The study of the past tells us that reefs are all about relationships and, like a family, for them to survive those relationships need to remain strong,? Peter Cowman said.

?In coming years it is probable reefs will be subject to relentless presses that may cause them to change fundamentally. Those with the best long-term prospects of survival will be the ones where the relationships between fish and corals are healthiest.

Both fish and corals managed somehow to survive the five great mass extinction events of the past, though they sustained massive loss of species. Over time these have left us with a world focus of reef biodiversity centered on the Coral Triangle region to Australia?s north, which in turn helps recharge Australian coral reefs, especially in the west.

?The Coral Triangle is currently subject to intensifying human and ecosystem pressure.? The latest work by Peter Cowman and Prof Bellwood suggests it is both a cradle for new species and a refuge in troubled times ? so it is vital that it remain intact.

?This isn?t about saving individual species or particular reefs, it?s about maintaining the basic relationships which ensure the survival of the whole,? says Prof Bellwood.

?We?ve had a ?heads up? from the past that is giving us fresh insights into what is most important on reefs and why we must protect our precious reefs and fishes into the future.?

Warren Buffett rocks out on ukulele for China

A hugely popular Chinese Lunar New Year variety show has a special guest star playing the ukulele: American billionaire Warren Buffett.

Buffett is shown wearing a dark sweat shirt and singing the folk song "I've Been Working On The Railroad" in the video posted on state broadcaster CCTV's "Spring Festival Gala" website Sunday.

There are no details on the website about where the 45-second clip was shot, but Buffett appears to be sitting in a small room with an elaborate model railroad set up in the background.

The video's simplicity contrasts with other performances posted on the website of the gala, which is usually a flashy extravaganza that draws 800 million viewers.

UK manhunt after prison escape in ambush

British authorities have launched an international manhunt for a murder suspect who escaped from a prison van in a ?well-orchestrated armed ambush,? including masked men, sledgehammers and a silver Mercedes.

West Mercia police said John Anslow, 31, escaped about 8:30 a.m. Monday while being transferred from Hewell prison in Redditch in central England to Stafford Crown Court.

Detective Inspector Jon Marsden said three men wearing balaclava masks used a silver Volkswagen Scirocco to block the van. They then?smashed the windscreen and windows with sledgehammers and punched the driver. The men were able to grab Anslow and all took off in a silver Mercedes, with the partial registration KR11.

Two other prisoners in the van were left behind.

"This was a serious criminal incident involving a well-orchestrated armed ambush,? Justice Secretary Kenneth Clarke told the Worcester News. "The first priority is to ensure that this man is quickly found and arrested."

Anslow, 31, was one of five men recently charged with fatally shooting a man in 2010.

Authorities told Britain?s Sky News Anslow uses the nickname Skits and is described as an extremely dangerous.

With abundant new supplies of gas making it the cheapest option for new power generation, the largest U.S. wind-energy producer, NextEra Energy Inc. (NEE), has shelved plans for new U.S. wind projects next year and Exelon Corp. (EXC) called off plans to expand two nuclear plants. Michigan utility CMS Energy Corp. (CMS) canceled a $2 billion coal plant after deciding it wasn?t financially viable in a time of ?low natural-gas prices linked to expanded shale-gas supplies,? according to a company statement.

Mirroring the gas market, wholesale electricity prices have dropped more than 50 percent on average since 2008, and about 10 percent during the fourth quarter of 2011, according to a Jan. 11 research report by Aneesh Prabhu, a New York-based credit analyst with Standard & Poor?s Financial Services LLC. Prices in the west hub of PJM Interconnection LLC, the largest wholesale market in the U.S., declined to about $39 per megawatt hour by December 2011 from $87 in the first quarter of 2008.

Power producers? profits are deflated by cheap gas because electricity pricing historically has been linked to the gas market. As profit margins shrink from falling prices, more generators are expected to postpone or abandon coal, nuclear and wind projects, decisions that may slow the shift to cleaner forms of energy and shape the industry for decades to come, Mark Pruitt, a Chicago-based independent industry consultant, said in a telephone interview.

The hard question, of course, is whether low natural gas prices will persist, particularly if everyone decides to rush into gas-fired generation:

?The way to make $4 gas $8 gas is for everyone to go out and build combined-cycle natural-gas plants,? Michael Morris, non-executive chairman of American Electric Power (AEP) Inc., said at an industry conference in November. ?We need to be cautious about how we go about this.?

Life is imitating art for new mom and "Up All Night" star Christina Applegate.

On the NBC comedy, Christina's onscreen daughter is about to turn 1, and off screen, her daughter Sadie (with fiance Martyn LeNoble) is also about to hit the 1-year mark.

"It's so weird how the show really does parallel my own life," Christina told AccessHollywood.com's Laura Saltman during a visit to the "Up All Night" set in Los Angeles on Friday. "Sadie's going to be 1 next week, so it's all sort of culminating at the same time."

For her daughter's birthday party, Christina said she and Martyn are keeping it simple as Sadie is too young to remember the fete.

"I only invited people with babies, so we've got about 10 babies and we're gonna do some things for the babies," she told Laura. "Do you remember your first birthday party? No! It's a photo-op. There is going to be an activity that Sadie actually really enjoys, so, you know, we'll be doing that, and that's it. Two hours, feed them some yummy stuff ... and then everybody leaves."

Christina also said (similar to her character on the show) that her home life has become completely centered around her baby - so much so that she and her composer beau forewent purchasing birthday presents for each other this year.

"For my birthday I [told him], 'Please, no gifts,'" she told Laura. "We both know that the other person's working so hard -- he composes all of the music for the show and he's working his butt off, and I'm working my butt off, so we both understand. Everything's about Sadie anyway."

As for wedding plans (the couple became engaged in February 2010, but has yet to tie the knot), Christina said their hectic schedules are interfering with nuptials.

"Of course [we will get married], but the schedule, the way that it is -- it's just almost impossible. It really is. It's insane," she said. "We kind of thought about, seriously, like a city hall thing. Like just going and doing it and being done with that part of it, then having a party six months from now."

While the actress would like to be married, she's not concerned about their marital status as she says having a child together is stronger than a marriage document.

"For me [getting married] doesn't add to the fact that we love each other and that we're going to be together and that we have this incredible human that bonds us for life -- literally for life," she said. "So, I think we're good.

Prof to seek dismissal of US child porn charge

(AP) ? An architecture professor arrested after firefighters battling a blaze at his Jersey shore home found a 1970s magazine depicting naked prepubescent girls plans to seek dismissal of the child pornography charge though a pretrial intervention program, his lawyer said Friday.

Attorney Hal Haveson told The Associated Press that Gamal El-Zoghby acknowledges the magazine found by firefighters Tuesday was his. But the 76-year-old professor at the Pratt Institute in Brooklyn, New York City, bought it decades ago and hasn't looked at it since, the attorney said.

"It was stuff he had discarded from his mind, just not from his home," Haveson said.

The magazine in question was but one of a collection of 60 or 70 magazines found by firefighters who responded to a blaze at El-Zoghby's waterfront home just before noon Tuesday, Haveson said. State police said only one magazine contained images of naked prepubescent girls.

The attorney wouldn't directly address why El-Zoghby had originally obtained the magazine, other than to say, "He had a reasonable, non-prurient explanation for that. It was not because he enjoyed child pornography." He declined to comment further.

The lawyer also said he's not sure that what's in the magazine meets the legal definition of child pornography. A lot depends on whether the images are intended to appeal to prurient or sexual interests, he said.

"My client doesn't know because he hasn't seen this in decades," he said.

The architect had intended for years to throw away the magazine but never did, his attorney said.

El-Zoghby is due in Eagleswood municipal court on Wednesday for a brief hearing, at which the judge is expected to refer the case to state Superior Court, Haveson said.

Ultimately, El-Zoghby will apply for New Jersey's pretrial intervention program, which lets certain first-time offenders charged with nonviolent crimes have their criminal record wiped clean if they complete the program and stay out of trouble. Prosecutors would have to agree to let him enter the program in order to avoid a trial.

"This is all stuff from the 1970s; that's really important," Haveson said. "What someone does in their younger years does not define the man. He is not a collector of child pornography. My client had not paid any attention to this in decades."

GM retakes title of top-selling global automaker

(AP) ? General Motors Co. has retaken the title of world's top-selling automaker, selling just over 9 million cars and trucks across the globe.

The company said Thursday that it sold 9.03 million vehicles worldwide last year, up 7.6 percent from 2010. That's more than 1 million better than Japan's Toyota Motor Corp., which took the title away from GM in 2008.

GM also beat Germany's fast-growing Volkswagen AG, which last week reported record global sales of 8.16 million in 2011, up 14 percent from the year before. Toyota said it sold 7.9 million vehicles worldwide last year.

GM had held the global sales crown for more than seven decades before losing it to Toyota as GM's sales tanked while it headed toward financial ruin. In 2009, GM filed for bankruptcy protection, needing a U.S. government bailout to survive.

Now GM is profitable again and its vehicles are selling well across the globe. The company reported net income of $7.1 billion for the first three quarters of last year, and it is expected to add to that number when it reports fourth-quarter and full-year results in February.

Toyota is aiming for a comeback this year and has predicted that it will sell 8.48 million vehicles in 2012. Its sales were hurt last year because the March earthquake in Japan slowed its factories, and dealers ran short of cars to sell.

Auto industry analysts predict a tight race this year between GM, Volkswagen, Toyota and the joint venture between Nissan and Renault.

Some analysts have said that VW is the world's biggest automaker because GM's figures include vehicles made by its Wuling joint venture in China. Many don't count Wuling because GM doesn't have controlling interest in the company, but GM includes it in global sales figures.

Excluding Wuling, GM would have been topped by Volkswagen.

Being the world's top-selling automaker doesn't mean much for the bottom line. But GM retaking the title is an example of how far the company has come since its 2009 bankruptcy.

GM CEO Dan Akerson said last week that the company isn't that concerned about posting large sales numbers and is focused more on making money so it can reinvest in products and generate returns for shareholders. But he says strong sales can bring strong finances.

"You're not going to achieve the financial goals we want to achieve and have declining market share or declining numbers of units sold," he said. "So it's one indicator among many."

GM said its sales were up in all four of its regions: North America, Europe, South America and International Operations, which includes Asia. The Chevrolet brand led the way, selling a record 4.76 million vehicles across the world.

GM sold 640,000 more cars and trucks last year than it did in 2010, when it sold 8.39 million.
